It is implementation of the law, whatever that law might be. This is what we should be discussing first, before we even touch any European directives."

I totally agree with your final conclusion and I believe that any attempt to introduce or reform any labor legislation (especially in Greece) prior convincing as Government for your ability to enforce the already existing one is absolutely dangerous for labor's rights. I might go even further, based on my experience so far, saying that such an attempt would definitely not aim to the improvement of labor's income.

Furthermore you've said:

"In my experience, most of them do it out of ambition, not out of need or because anybody is making them (hence they might not sign opt-outs). Very long working hours is endemic in “high flying” jobs and I don’t see why it shouldn’t be. Such a legislation being enforced in UK or in Greece might force (in an indirect manner) those that wish to work more out of ambition to work even more then than what they are doing now.... and so on. That's misery. Living to work.....and then...you suddenly die. Humans' purpose is supposed to be something different, isn't it?

I have the feeling that we are looking at the wrong direction.
There must be some other way to get there.Excaperhttps://www.blogger.com/profile/03225607828282183666noreply@blogger.comtag:blogger.com,1999:blog-2098410698862974038.post-61182293949970101252008-06-18T02:42:00.000+03:002008-06-18T02:42:00.000+03:00@DonI asked whether the working conditions aspired...@Don
I asked whether the working conditions aspired by this directive (by which I meant if properly implemented) are better or worse than the conditions under which most young Greeks in the private sector are working (by which I mean what is the real situation in the Greek market now – not what it would be if all the existing laws/directives were obeyed).
You answered “worse”. If this is the case, fair enough and I am with you. We are better off without this new directive.

However, from what I read in this blog and what I hear from friends and relatives who live and work in Greece, I was under the impression that a very substantial number of workers, especially young, already work over the 48-hour limit. And they do so unofficially, without it being in their contract (without having a contract at all at times), without getting paid for it, without being insured, without a pension scheme.
Based on the above, I was asking this: Is it not more likely to get the benefits of your hard work when you do it legitimately? -When it is in your contract and you can actually prove that you are doing it?
You and G700 indicated that based on what is already happening at the moment in Greece, where a “friendlier for the worker” legal framework is not implemented, a framework that would benefit the employers would be even more difficult to implement. This is counterintuitive and it smacks of bazaar mentality, but I’ll stick with it. In that case, what is the legal framework that actually could be implemented? Is there one?
The problem then is not this directive, or any other. It is implementation of the law, whatever that law might be. This is what we should be discussing first, before we even touch any European directives. Because if we are willing to surrender to this logic of inability to implement anything, then morally and practically there is only one solution: dissociation of productivity from salary. So you should do that and good luck to you.

@ G700 on the UK
Statistics is a funny thing. The fact that two-thirds of British workers are unaware of the 48-hour limit does not mean that they are working over 48 hours. But the truth remains that in places like London as many as 15% of workers do work over 48 hours. In my experience, most of them do it out of ambition, not out of need or because anybody is making them (hence they might not sign opt-outs).
Very long working hours is endemic in “high flying” jobs and I don’t see why it shouldn’t be. Whoever has ambition should be allowed to pursue it. But there are many, many jobs that are 9-5. They don’t all have to be 60-65 hours per week jobs and they are not. That’s the bottom line. You choose what you want to do.
Unless you are an illegal immigrant. They are generally made to work crazy hours for nothing in jobs that are certainly not “high flying”. Why? -Because they are outside any legal framework. Just like many young Greeks in Greece.Ventriloquisthttps://www.blogger.com/profile/00897219535577503193noreply@blogger.comtag:blogger.com,1999:blog-2098410698862974038.post-92013989604381169362008-06-18T02:38:00.000+03:002008-06-18T02:38:00.000+03:00This comment has been removed by the author.Ventriloquisthttps://www.blogger.com/profile/00897219535577503193noreply@blogger.comtag:blogger.com,1999:blog-2098410698862974038.post-55488570848593514912008-06-17T17:01:00.000+03:002008-06-17T17:01:00.000+03:00ventriloquist said...A./"1. However, it allows for broad derogations (article 18) and needed reviewing following a number of European Court of Justice rulings.

The 2008 Working Time Directive inserts a clause, under which workers could effectively put in up to 60-65 weekly hours.

This is in accordance to one of the UK government's main demands, while ETUC, the European Trades Union Confederation, and a bunch of european nations lobbied heavily against it asking for it to be scrapped all together.

You asked about Working Time in the UK.

According to ETUC over the last ten years, the opt-out has been widely abused in the UK. Research indicates that two-thirds of British workers are unaware of the 48-hour limit. In addition, two-thirds of long-hours workers say they have not signed an opt-out, and one-third of those who have, say they were given no choice .

So just imagine what would happen in Greece, the country of low employment and rigidanomy, if this is the case in the UK, a country of high employment and effiecient labour market institutions.

Thus G700's position on that matter is that the Directive must be revised to phase out the individual opt-out as soon as possible. Potentially there could be talk of keeping the derogation only for CEOs and only under a strict regulatory regime.G700https://www.blogger.com/profile/02148911035437562534noreply@blogger.comtag:blogger.com,1999:blog-2098410698862974038.post-70869213121367436182008-06-16T19:13:00.000+03:002008-06-16T19:13:00.000+03:00vaggelas said......η αύξηση των ωρών είναι η μόνη ...vaggelas said...

Anonymousnoreply@blogger.com
